Story of Dietetic Boards Prosecution:

Practicing Dietetics Without a License

For the next 4 years Dr. Popper was forced to hire two attorneys, subpoenaed to turn over client and instructor information, as well as class outlines for everything on The Wellness Forum calendar, and even threatened with jail. At one time she was threatened with incarceration for failing to comply with a subpoena that requested, among other things, a list of other practitioners who were engaged in the same activities as Pam.  The investigation ended when elected officials began looking into the activities of the board, and discovered that it had investigated close to 800 people during one 5-year period, and taken disciplinary action against close to 300 of them.

Her story is not uncommon across the country. Rouge dietetic boards are trying to establish themselves as the only people who can talk about nutrition. They do this by passing “turf protecting” laws under the guise of consumer protection.

Under a similar act in Florida, Anida Bruce was Arrested, Handcuffed, Strip Searched, Put in Prison, and Released on $10,000 Bail "For practicing nutritional counseling without a license".

FDA Bill became law in Florida:  for this heinous Florida crime Anida Bruce was recently Arrested, Handcuffed, Strip Searched, Put in Prison, and Released on $10,000 Bail "For practicing nutritional counseling without a license". Until she was arrested and put out of business, Anida Bruce had a large and growing practice of grateful clients. She has had over 24 years experience giving UNC. She has helped hundreds find far better health with nutrition. She has been forced out of business and has had to sell her home, and to borrow thousands of dollars for her legal defense. Patty Shipley, a Naturopathic Doctor of Ohio, has been investigated twice by the Ohio Dietetics Board for practicing nutrition/dietetics without a license.
She has spent over $20,000 to protect her business from being closed down because of their Dietitian Licensure law.

She had put a flier up in Wild Oats for a basic nutrition class and a complaint was made by a dietitian who saw the flier. Patty was told by the Dietetic Board that she was breaking the law and was given a cease and desist letter. She was told that she was not allowed to give out nutrition advice, or even suggest a nutrition book to others, as this would be considered to be holding herself out to be a nutrition expert. She had to agree to quit giving nutrition classes.

She used the ND title (for Naturopathic Dr), and that there is also a Nursing title that uses ND and a complaint was made to the state medical board. The medical board said they saw no reason for an investigation, but told her to use "Naturopath" instead of Naturopathic Dr. Or ND.
The Ohio Dietetics board told her in December of 2006 that they felt she was practicing dietetics.
·After being investigated and spending thousands of dollars in legal fees, she was told she could continue her practice.
She states that other practitioners, who don't have this kind of money, have to close down their business or move to another state.

This book is also about how government, acting on behalf of and in conjunction with certain groups of medical professionals, pharmaceutical companies and other organizations with a financial interest in the health care industry, has been gradually restricting our health care choices, and the impact these restrictions can have on your life, your family's life and your community.

It's time to take control of our government, our health and our future, but we cannot do it without engaging everyone in this effort. The largest special interest group in the US consists of people who want to make their own decisions about health - if all of us join together and pool our resources, we'll be able to outspend the pharmaceutical companies, the practice groups, insurance companies and many others who work hard to preserve their monopoly. And, we'll be able to convince politicians that their ability to be re-elected depends, in part, on their willingness to represent the voters who want reform in the area.

On January 25, 2000 in Ohio before House hearing on the ODA bill a member of the Dietetics board testified
"We (the Dietetics Board and staff) are not trying to interfere with free speech. Someone could go across the street to the Ohio Theater and someone can rent the Ohio Theater and give a nutrition lecture. The Board would no nothing to stop the lecture."

The ODA board repeatedly harassed Pam Popper and Patty Shipley (a member of a church that believed in healthy lifestyles) who was giving free nutrition advice.
Pam's attorney found she was:
 

  • NOT ENGAGED IN THE PRACTICE OF DIETETICS AR DEFINED BY OHIO LAW.
  • Many of her activities are covered by her rights to free speech as guaranteed by the First Amendment to the US Constitution and Article 1, section 11 of the Ohio Constitution.
